On Nov. 13, the Planning and Zoning Commission denied small business owner Nelson Riley a conditional use permit that would allow for the sale of alcohol at 1504 Aquarena Springs Dr.
Riley planned to turn the lot into an Eskimo Hut, a convenience store that sells daiquiris at a drive-thru window. But concerns by city staff and the San Marcos Police Cheif over the sale of alcohol through a drive-thru was a determining factor in its denial.
So why was the CUP denied when other businesses, like HEB, provide this exact business model to its consumers?
